I represent and warrant that my child is in good health and physically capable of playing at Ocean’s Playhouse. I do not have any known physical limitations, disabilities or health problems which will present any increased risk to my child. I understand and acknowledge that my child’s entrance to and enjoyment of Ocean’s Playhouse is voluntary. I accept and clearly understand there are inherent and other risks, dangers and hazards associated with the entering and playing in a play-place such as Ocean’s Playhouse which can result in serious personal injury or death and that serious personal injuries are a common and ordinary occurrence in children’s play. I FREELY ASSUME ALL RISK OF INJURY ASSOCIATED WITH ENTRANCE INTO AND ENJOYMENT OF OCEAN’S PLAYHOUSE. I further understand and acknowledge that the other children, parents, guardians, and patrons have no affiliation with Ocean’s Playhouse, M&L Sons, LLC, its members, employees, agents, or other officers (“Ocean’s Playhouse”), and that Ocean’s Playhouse makes no representations as to the behavior of the other children, parents, guardians, and patrons.

I, the undersigned, on behalf of myself and my Child, in consideration of my entrance to and use of the Ocean’s Playhouse playplace, hereby WAIVE, RELEASE, REMISE AND FULLY DISCHARGE, and agree to DEFEND, HOLD HARMLESS AND INDEMNIFY M&L SONS, LLC d/b/a OCEAN’S PLAYHOUSE, its officers, directors, members, agents and employees from, any and all claims, demands, losses, damages or liability for property damage, personal injury, wrongful death, loss of services or otherwise which may result from or arise out of my entrance, use and enjoyment of the playplace located at Ocean’s Playhouse, including any claims or actions arising out of negligent acts or omissions (active or passive negligence) of any of its officers, directors, members, agents, employees, or other children, parents, guardians, or other patrons.

I accept for myself, full responsibility for any and all injuries or damages of any kind which may result from the entrance to, use, and enjoyment of the play place at Ocean’s Playhouse. In the event that I am signing this release as a parent or legal guardian of a minor, I represent and warrant that I have full authority to do so, realizing this release is binding upon the minor as well as myself. In addition, if I am signing as a parent/guardian of a minor, I agree to indemnify and hold harmless M&L SONS, LLC d/b/a OCEAN’S PLAYHOUSE from any claims, demands, losses or damages resulting or arising from the entrance to, use, and/or enjoyment by the minor child of the play place located at the Ocean’s Playhouse. This release and hold harmless agreement is intended to and shall be binding on my heirs, personal representatives, executors, administrators and assigns. The sole and exclusive venue of any dispute that may arise out of this Agreement, or otherwise between the parties hereto, shall be the Circuit Court for Worcester County, Maryland.

I SIGN THIS RELEASE FREELY, VOLUNTARILY AND WITH FULL KNOWLEDGE OF ITS SIGNIFICANCE. CAUTION: READ BEFORE SIGNING - THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS AND WILL BAR YOUR RIGHT TO SUE!
